Terms
In force from 15 October 2026.
1. Seller
theymakethings.com (They Make Things) is run by Datar Prosta Spółka Akcyjna, registered office ul. Drwęcka 18/30, 04-393 Warszawa, Poland, entered in the National Court Register (KRS) by the District Court for the Capital City of Warsaw under no. 0001149989, NIP (tax ID) 1133156500, REGON 540681275("we"). Email: [email protected]. Electronic delivery address: AE:PL-80423-50815-GCFER-28.
2. Scope
- These terms cover the website's online services and contracts to design and make custom parts, and the sale of ready parts from our library.
- "Customer" means a consumer, a sole trader for whom the contract is not of a professional nature ("sole trader with consumer rights"), or another business. Consumer provisions apply to sole traders with consumer rights as far as the law provides.
3. Online services
- Free of charge we provide: the request form, a private design page (3D preview and fit questions) and email correspondence.
- Requirements: an internet-connected device, a current browser with JavaScript enabled, and an email address or phone number.
- The online service contract starts when you send a request or open a design page and ends when the matter is closed. You can stop using it at any time.
- Don't send unlawful content or content that infringes others' rights.
- Complaints about online services go by email; we answer within 14 days.
4. Making a contract
- A request (via the form or email) is not an order. We answer it with a free quote and, for most small parts, a first concept. Neither obliges you to order.
- We send the offer by email or on the design page. It states: the part, its material, the things and dimensions it must fit (assumed dimensions marked in red), the total price including VAT, the delivery cost, how and when to pay, the lead time, and whether a right of withdrawal applies.
- The contract is made when you accept the offer by email or on the design page. We confirm its content by email.
- Contracts are made in Polish or English.
5. Prices and payment
- Prices include VAT. Delivery is priced separately in the offer.
- You pay in advance by bank transfer to the account in the offer, or another method it names, within the time it states (7 days by default). After that the offer lapses.
- The price doesn't change after you accept. Changes you ask for later are quoted separately before we make them.
- We send the invoice or receipt by email.
6. Making and delivery
- The offer states the lead time. It runs from receipt of payment and your approval of the design.
- We ship to the address in the order as described on Delivery. Outside the EU, duty, import VAT and carrier fees are paid by the recipient.
- If you are a consumer, the risk of loss or damage passes to you when the parcel is handed to you.
7. Non-conformity and complaints
- Towards consumers we are liable for a lack of conformity with the contract that exists at delivery and becomes apparent within 2 years (Articles 43a–43g of the Polish Consumer Rights Act). Conformity is judged against the accepted offer.
- If a part doesn't conform, you can ask for repair or replacement and, if that is impossible or doesn't happen, a price reduction or termination.
- Send complaints to [email protected] with a description and photos. We answer within 14 days.
- Fit promise: if a part doesn't fit the things we agreed it would fit, you choose a 100% refund or an improved version at no cost. If the cause was a measurement you gave us, we fix the design and the new part costs production only. The promise is not a guarantee under Article 577 of the Polish Civil Code and doesn't limit your statutory rights.
- Towards businesses other than sole traders with consumer rights, warranty for defects (rękojmia) is excluded (Article 558 § 1 of the Civil Code); the fit promise applies. Our liability to them is limited to the price of the part, except for intentional damage.
8. Withdrawal
- A part made to your specification or clearly personalised can't be returned without reason: the right of withdrawal doesn't apply (Article 38(1)(3) of the Polish Consumer Rights Act, Article 16(c) of Directive 2011/83/EU). Its STEP file is part of such an order. The offer says so before you pay.
- A consumer can withdraw from buying an unchanged library part without giving a reason within 14 days of receiving it, by sending us a statement by email before the deadline, for example using the model form below.
- We refund the payment, including the cheapest delivery we offered, within 14 days of receiving the statement, using the same payment method. We may hold the refund until we receive the part or proof it was sent.
- Send the part back within 14 days to Datar Prosta Spółka Akcyjna, ul. Drwęcka 18/30,04-393 Warszawa, Poland, at your cost. You are liable for loss of value caused by handling beyond what is needed to check the part.
Model withdrawal form. To: Datar Prosta Spółka Akcyjna, ul. Drwęcka 18/30,04-393 Warszawa, Poland, [email protected]. I/We hereby give notice that I/We withdraw from my/our contract of sale of the following goods: … Ordered on/received on: … Name of consumer(s): … Address of consumer(s): … Signature (only on paper): … Date: …
9. Designs and rights
- You get the part and its STEP file and may use and modify the file for your own needs without time limit.
- The general design (template) stays ours and we may reuse it for other customers, without your measurements, photos or details. On request we sign an NDA and don't reuse the design. Transferring rights to the design itself needs a separate written agreement.
- By sending materials you confirm you may use them for this purpose.
10. Safety
Use the part as stated in the offer and the instructions in the box. We decline the things listed in What we won't make.
11. Disputes
- Consumers may use out-of-court dispute resolution, such as a Polish municipal or district consumer ombudsman or the permanent consumer arbitration court at the Trade Inspection. Information: prawakonsumenta.uokik.gov.pl. Consumers from other EU countries can contact the European Consumer Centres Network.
- Polish law applies. Consumers keep the protection of the mandatory rules of their country of habitual residence.
- Disputes with businesses other than sole traders with consumer rights go to the court competent for our registered office.
12. Final provisions
Changes to these terms don't affect contracts already made. We process personal data as described in the privacy policy. This English version is a translation; if they differ, the Polish version prevails unless the English one is more favourable to a consumer.
